Canada to Increase Patent and
Trademark Maintenance Fees

The Canadian Intellectual Property Office (CIPO) will be increasing many of its fees relating to patent and trademark maintenance starting January 1st, 2024.

PATENT MAINTENANCE

The maintenance fees for standard entities will increase accordingly. For the 2nd- 4th anniversaries of the filing date, the fee will increase from $100 to $125; for 5th-9th anniversaries, from $210.51 to $277.00; for 10th-14thanniversaries, from $263.14 to $347.00; and for 15th-19th anniversaries from $473.65 to $624.00.

The maintenance fees for small entities are only increasing for the 15th-19th anniversaries, from $236.83 to $253.00.

TRADEMARK MAINTENANCE

Fees for the renewal of the registration of a trademark — if the request and the fee are submitted online through CIPO’s website — will change accordingly. For the first class of goods or services to which the request for renewal relates the fee will increase from $421.02 to $555.00. For each additional class of goods or services to which the request for renewal relates the fee will increase from $131.58 to $173.00.

Fees for the renewal of the registration of a trademark — if the request and the fee are submitted through any means other than through CIPO’s website —  will increase accordingly. For the first class of goods or services to which the request for renewal relates will increase from $526.29 to $694.00. For each additional class of goods or services to which the request for renewal relates, the fee will increase from $131.58 to $173.00.
